Question: I am a foreigner living in South Africa with my South African husband and our two children. I only have a temporary residence permit and Home Affairs has lost my Permanent Residence application, so I have to start from scratch again. Are we allowed to register a new business in our children’s names (they are double citizens) and then I officially work for them (therefore apply for a work permit), meaning run the business entirely myself?

Answer: Your query has strong legal undertones and I suggest you consult an Attorney with regards to your situation. I see no problem with your children registering a business as they are dual citizens and then employing you will have no adverse recourse as foreigners are now protected via labour legislation with regards to employment. Read my posted article on labour rights for foreigners.
