Question: I am a foreigner living in South Africa with my South African husband and our two children. I only have a temporary residence permit and Home Affairs has lost my Permanent Residence application, so I have to start from scratch again. Are we allowed to register a new business in our children’s names (they are double citizens) and then I officially work for them (therefore apply for a work permit), meaning run the business entirely myself?
Answer: Your query has strong legal undertones and I suggest you consult an Attorney with regards to your situation. I see no problem with your children registering a business as they are dual citizens and then employing you will have no adverse recourse as foreigners are now protected via labour legislation with regards to employment.
