Never Ending Retrenchment

Question: In my retrenchment letter it talks about one additional months pay for May (which is my notice period) to be paid. What i would like to know if it’s compulsory for me to work that month and if i don’t, do i still receive this money.

Answer: The Company has the discretion to ask you to either work your notice period or not, however, if they ask you to do so and you do not tender your services, they have strong grounds to withhold the months notice. However, in general, Companies pay this one months notice as part of a severance package and do not require the employee to work for that month. It is rare for employees to work their notice period during a retrenchment process.
