Question: Is it discrimination when an employee gives urine screens to a certin rank of employees?
Answer: An employer has the right to ensure that staff are not under the influence of drugs and/or alcohol and may institute any measures as necessary to determine such. This would normally be contained within the company policies and codes of practice. In general, such screening should apply to all, however, the employer may be selective on a certain “rank” if the inherent job requirements necessitate such screening.
