Question: Last year October 2008, after i had resigned from my position, the company I work for offered me a sallary increase if i would stay. The agreement was that for the next four months they would pay me the increased salary and after this period they will re-evaluated the situation. Now 7 months has passed and my salary remained at the same incresed amount. In the begining of May 2009 they came back to me and said that if the financial situation in the business doesn’t change they will cut down my salary. In the same time in January 2009, they employed another employee. I would just like to find out wat my legal rights are in this matter.
Answer: Yes, the company may not merely reduce your salary without due consultation and your consent. Unless they gave you a written and signed undertaking with regards to your increases and periods, you do not have much of a leg to stand on as currently without a signed undertaking they have not done anything wrong. Further, the company has all rights to employ anyone they want to regardless of current financial status.
The Country is currently in a recession and employment is very scarce so I would suggest that you think about your actions very carefully before proceeding into any course or direction that may jeopardise your employment. If you are unhappy I would suggest that you seek alternative employment and resign once you have secured another position.
