Verbal Appointment

Question: Is a verbal appointment binding like I was employed as a supervisor of a Building but because of my past building experience the owner ask me to convert the building from flats to a hotel and said that he will pay me at The end of the contract for the construction work. Because I was already Earning a salary very small as the supervisor he could not give me a contract a the project manager is this legal.


Answer: Yes any verbal agreement is legal and binding within South African Legislation.

However, you are in a far stronger position within Labour Law as any person who works for an employer for more than 24 hours in a month period is automatically granted all rights of a permanent employee regardless of the existence of a signed written contract of employment. You have every right to refer the matter to CCMA in the form of an unfair labour practice referral. You would state your case as you have described it to me.
