Accured Leave – Statutory Payment

Question: My boyfriend, had a hearing at his job with no warnings against him and after the hearing they asked him to come back to work because they didn’t have anything against him, so he resigned, because he coudn’t work there anymore, because his manager keep swearing at him and don’t treat him right. Now my boyfriend would like to have his leave money back, and they refuse to pay him, thet said he owe them money cause he resigned without 2 weeks notice. Could you please help me and give me an answer.


Answer: All accrued leave pay is called a statutory payment and has to be paid out by law. The company cannot hold it or deduct notice from it.
Ask your man to lodge a complaint with the Dept.of Labour stating that his company refuses to pay him his accumulated leave pay. The Dept. will ‘force’ the company to pay it out. If your man didn’t give correct notice and depending on clauses in the employment contract this forfeited notice may be deducted from salary owed but not statutory leave pay.
