Notice of Retrenchment

Question: I have been given notice of retrenchment at my company. Where do I stand with my Restraint of trade?. Living in a small town my optionals of finding another employment is very difficult. I have children to support.

Answer: A restraint is unforceable and becomes null & void with a retrenchment scenario. Thus find any job you can now, regardless of position, industry etc… Don’t worry about the restraint at all! Termination is not of your doing and this is why the restraint fall away.
