Working With No Contract

Question: I have been employed for 6 years the first 3 years I had a contract of 3 years and then it expired and it was never renewed i asked my employer everytime about it he said he will give me a new one until today I’m working without a contract. Two weeks back he gave me a retrenchment notice without even discussing it with us, I tried to challenge it and now im being unfairly treated and he did not pay my salary that I get on the 15th of each month and he has not said anything about the retrenchment since.

Answer: This is most definitely irregular. First step is to contact the department of labour an lodge a complaint as to non payment of salary. They will take up the matter on your behalf at no charge as it is a government service. If your services are subsequently terminated for whatsoever reason you will then need to approach the CCMA for relief. But as said get your salary first, they may even assist with your current situation.
