Question: How do I legally force an answer out of my employer after the interview? It has been 3 months and my HOD made the mistake of telling me ‘in confidence’ I will be promoted. Now her superiors are BS* us and beating around the bush. They never have a straight answer and they also have not hired anyone else.
Answer: You cannot force any decisions and I advise not to. Any promotion is solely at the employers discretion and they have every right to decide yes or no. The economy is bad at the moment and they may be waiting for an upturn. Wether your HOD told you or not is irrelevant as the final decision will not be hers. Judging buy your query you have obviously queried your promotion numerous times already. When they are ready they will make a decision. Be careful not to become an irritation. As a national HR manager myself I would become hesitant with constant pestering and be careful they merely say NO to get rid of the bother.
I suggest you write a letter to the HR manager stating that you would like to find out on any progress on the promotion and that following the letter you will not raise any further queries in this regard and will await their outcome. If someone else is given the promotion then you can fall back on the letter and there are routes you can then follow. Remember to keep copies of all correspondence. Good Luck!
