Short Time to Avoid Retrenchment

Question:

If a company starts short time to avoid retrenchment does this option have to be offered to all employees? Do es voluntary retrenchment also have to be offered to all employees?

Answer:

No not necessarily. Short time may be applicable to a certain department/section etc… As such decisions are normally operationally based so it may be selective. There must be a valid reason for such selection and due consultation with staff. One can also implement short time on a rotational basis with various departments e.g. One department this week and the other next week as to ensure equity. Retrenchment equally is operationally based and can be as selective as one person dependent on company restructuring plans.
