Question:
I was employed by a company for 8 months. I resigned, and gave them 2 weeks notice as per the CCMA. They now refuse to pay my final salary, including my leave pay, for the reason that they first want to conduct an audit on my work, and if they are satisfied, they will take action. I referred the matter to the CCMA, but they informed me that they do not have jurisdiction to hear the case. What am I to do? I resigned on the 10th of July 2009, with my last day being the 27th of July 2009. The last time they paid me was 30 June 2009. Also, I am sure I can hold them responsible for any penalties/fees I had to pay at the bank?
Answer:
The CCMA has no jurisdiction on unpaid salary, leave etc… Lodge an immediate complaint with the Dept. Of Labour for unpaid monies. This is a free service and they enforce compliance and payment bud. They are surprisingly efficient. Contact your local Dept ASAP.

I was award by the CCMA to be back paid and to be reinstaed. But the company refuse to do that and they want to review the award.
