Pay Minimum Wage Without Overtime

Question:

I am opening a new restaurant in East London. Is it possible to hire waiters/kitchen staff for a 48 hour week and still pay minimum wage without overtime?

Answer:

In short no. Law states that a working week is 40 normal hours and a maximum of 10 hours overtime , thus the 8 hrs would be at overtime rates. You could play around with shift times to equate to 40 hours per employee I.e. Have your normal staff and a relief staff member to cover the excess hours over 40.
