Question: Hi there. I would just like to know one small thing. I have just resigned from a company where i have been for 1 year 4 months. What payouts, if any, will I get? Eg pension fund, leave pay, sick leave etc.
Answer: You will receive any accrued leave pay due, sick leave is not an advanced payment so sorry nothing there. You will need to speak with payroll and complete a pension fund withdrawal so that they can pay out monies due. Yup that about it then.

After working at an Attorney’s firm for 18 months I resigned on the 16th February 2010 indicating that my last working day will be on 31 March 2010.
Then on 27 February 2010 at 23h39 my employer at that time send me an sms indicating that I should clear my table on monday 1 March 2010 and that she is releasing me from my duties and leave period.
On the 1st of March 2010 I cleared my table, paid my telephone bill and give back my keys.
I immediately started working for my new employer but only for half days, as I formally would start employment with him on the 1st of April 2010.
From the 1st of March 2010 I constantly smssed and phone my previous employer regarding my payment for my leave month, because according to me she still has to pay me, and I also have not received my leave pay. She keeps telling me that she will speak to the bookkeeper.
I waited until payday 25 March 2010 and nothing happend. I spoke to the Bookkeeper tonight and according to her my previous employer never raised the subject with her.
What am I legally supposed to do? What rights do I have?
Lodge a complaint via the Dept of Labour. They will enforce payment and are a free service
Hi Craig, I want to know how employers should work out (the formula) how much to pay out a worker that has resigned. My friend has a situation where he worked for a take-aways place for 13yrs (4yrs for the previous owners & 9yrs for the current) permanently and continiously and when he resigned only got 3wks pay paid out to him. Shouldn’t they pay out more? Take in concideration that they don’t have pension fund there. He could get no other money out except for the resignation payout. If I’m correct, wasn’t the formula previously 10% of yearly earnings times the years worked for them?
With resignation all that is due is notice pay and any accrued leave.This is not a retrenchment its a resignation.You are not correct there was never a formula for resignations.
I have a domestic worker that has been working for 6 years and yesterday just told me that she wants to resign effective immediately
