Unilaterally Reduce Hours

Question:

I am an employer who needs to shorten the work week and reduce the salary of one of my three employees. She is LIFO. This is the step I am taking before having to retrench her. What are the correct procedures to follow? Can she refuse to accept the offer and what do I do then?

Answer:

You cannot merely unilaterally reduce the hours and salary. Consultation with staff is required. I suggest you call them in and state that things are not golden and that you may have to start retrenchments proceedings however you have some alternative before this. Tell them of your proposals I.e. Reduced hours and salary.

State that you have no other options and need their response. If the accept then you need to conclude a written acceptance of the terms. I can assist with this. If not then you need to implement retrenchment procedures.
