Domestic Workers and Pension

Question:

Can you please help me. My mother’s domestic worker is going on pension at the end of this year. She has been in her employ for 27 years now. What needs to be payed out to her. I heard that it is one week’s salary for every year she worked for her. Can you kindly assist me.

Answer:

That payment you have mentioned is for retrenchment not pension so doesn’t need to be paid out. All that needs to be done is that the employer give her a letter of pension basically stating as of a certain date she will go onto pension. The maid will need to go and register to claim her pension at the Dept of Labour. She needs to be paid out any accrued leave and I normally payout 1 months notice.
