Question:
I am currently working for a Broker. He has employed me in Feb 2009. He always has a problem when it comes to paying my salary. We have agreed to R 6000.00 per month and 10% commission on every client I give him and he successfully writes up. He needs to pay me R 13000.00 this month and refuses to pay me because he has not enough money. He received R 107 000.00 commission this month and R 56 000.00 was paid out to him up to date. What can I do to receive my money? I do not have a written contract with him because he does not want to give me one after asking several times. I am still working for I do not want to walk out. I just need help to what I can do to get my money from him.
Answer:
By law you are entitled to a contract of employment and are already afforded all the rights of a permanent employee. The only steps that you may take at this stage is to contact the Dept of Labour and lay a formal complaint with regards to non payment of salary. They will ensure that he complies with what is due.

I was let go due to re-trenchment. All documents were signed by my employer agreeing that he will pay my last salsry and he has still not. The process went so far, i won every step and it even went to the extent where they needed to remove his goods from his work place and in order for the process to have continued i needed money to hold his goods in storage. This is not right. It is my money. Why do i need to fught so hard for my own money. There is no fairness in the labour law process. i need to get my money that i worked for and that he has promised in black and white he would pay me and still i didnt get it. Why? because i needed money to hold his goods!!!! I dont have money as he never paid me. The rich get away with all sorts of things. I am sure he played the system.
