Under Performance for Job Function

Question:

I have been working for a company for 9 months not and have had no contract given to me, my basic salary is R5000.00 and I only get paid R25.00 for over time, is this right, next thing is I was given a hearing for under performance in my job function but I do not even have a job description? What is my next steps?

Answer:

By law an employee must be given a contract of employment. Overtime must be paid out in accordance with prescribed rates. I would suggest you chat with management and request a contract and correct OT payments as prescribed by labour legislation. Work performance is a process and they need to assist you with any issues before disciplining.
